SUBSTANSI NASH KEWAJIBAN NAFKAH DAN RELEVANSINYA DENGAN UNDANG-UNDANG PERKAWINAN KONTEMPORER

Abstract

The living is husband's obligation to be responsible for all household needs. Rules regarding livelihoods have existed since the Prophet Muhammad time until now developed according to social society conditions. At current conditions, many wives have worked, even the husband and wife roles in the household have been reversed. So in this situation, can the living concept change to become an obligation for husband and wife to meet household needs?. This article describes the living concept in Marriage Law and Conventional Fiqh, and texts regarding the living obligation by reviewing asbab al-nuzul aspects and Arabic historicity, which are then analyzed using maqashid syariah theory adapt to current living demands.The research aim is to examine the substance of living obligation in the text and its relevance to the contemporary Marriage Law using a literature review method. The research results show that the obligation to provide the living remains the husband's primary responsibility, even though the wife also works and the wife is obliged to help her husband if primary needs in the household have not been met, provided that she still has to carry out her duties and obligations well.
