ANALISIS HUKUM TERHADAP PERBEDAAN STRATA EKONOMI SEBAGAI HAMBATAN PERSETUJUAN PERNIKAHAN DI KECAMATAN AMUNTAI SELATAN KABUPATEN HULU SUNGAI UTARA

Abstract

This difference in economic strata is often a major obstacle in obtaining the blessing of parents or extended family, even though both parties of the prospective bride and groom already love each other and are willing to live a married life together. Thus causing both parties to decide not to continue to the level of marriage. The purpose of this study is to find out the influencing factors in marriage obstacles due to differences in economic strata and to find out the legal analysis of views on marriage obstacles due to differences in economic strata. This type of research is field research, which uses qualitative methods, then data is collected using observation, interviews and documentation methods. Then data processing is carried out with: Data reduction, data display, and data verification. After that, it is systematically analyzed based on applicable legal norms. The results of this study are: 1) Factors that influence the difference in economic strata as an obstacle to marriage approval, namely, - Not working (unemployment), - Lazy Work (lack of motivation to work), - Dowry Pressure and Marriage Costs, and financial uncertainty. 2) Legal analysis of differences in economic strata as an obstacle to marriage, namely, that the Right to marry is a fundamental right, and Marriage must be based on free consent without any discrimination. The implication: The state and society are prohibited from inhibiting a person's right to marry based on differences in economic strata. And cannot be an obstacle to a marriage because of differences in economic strata
